These terms and conditions apply to services provided by Silly Billy Sports.
Parents agree that by way of enrolling in our program they are permitting their children to take part at their own risk. and also accept all risks associated with the activity including injury, permanent incapacitation, death, loss and damage and further agree to be bound by the Silly Billy Sports Code of Conduct and operating rules.
I acknowledge that my child will not engage in any conduct, on or off the field, which places other participants at risk of injury or death and/or which is in the opinion of Silly Billy Sports, considered to be unreasonable or unsportsmanlike behaviour.
I guarantee that I will disclose any pre-existing medical or other condition that may affect the risk that either my child or any other person will suffer injury, loss or damage and waiver any claim they might have on.
TIMETABLE CHANGES
Classes timetables are subject to change. While Silly Billy Sports uses its best efforts to operate classes as per the timetable published on our website, in some instances changes are required due to unforeseen circumstances. No guarantee is made that classes will run 100% as per the advertised timetables. Any changes to the advertised timetables will be communicated to those affected prior to the commencement of the class/event.
REFUND POLIVY
We offer a FREE TRIAL class to ensure that both you and your child are satisfied with our program prior to joining. Therefore, NO REFUNDS ARE AVAILABLE (this applies to all Silly Billy Sports program bookings where paid).
PAYMENT TYPES
We accommodate varied payment methods via Paypal, cash or bank account.
CANCELLATION POLICY
As we offer a free trial for the satisfaction of child and their parents in our program before enrolling, therefore we do not offer refund in any case.
MAKE-UP CLASS POLICY
If your child is unable to attend their program due to illness or travel we are unable to suspend their membership, however they are welcome to attend a make-up class where convenient. A maximum of two (2) make-up classes per term are available. Make-up classes do not carry over to the next term and no credit is available for classes missed.
Make up classes are not provided for Special Events.
FEE PAYMENT We only take bookings for an entire term and structure our fees this way. Unfortunately, we cannot take casual bookings or pro-rata weeks you may be away. Please refer to our make-up class policy for missed classes. All fees must be paid before the commencement of each term. If fees are not paid by this time your child may not attend any class.
PARENTAL ATTENDANCE
Parents or Guardians are required to be present for the duration of each class. We encourage parents’ participation in classes to maintain class structure. In many instances, classes are more beneficial for participants and run more smoothly with the involvement of parents or guardians. We highly value the benefit of parents supporting their children in their health and wellbeing development.
Silly Billy Sports is not a registered child care provider and is not therefore licensed to care for children without parental or guardian supervision. In the unlikely event that your child requires first aid during our classes, this will remain the responsibility of the parent.
PHOTOGRAPHY & SOCIAL MEDIA
From time to time your child may be photographed or filmed on video whilst undertaking a Silly Billy Sports class/event. Such footage might be used for promotional purposes, including but not limited to reproduction on the Silly Billy Sports website and social media platforms such as Facebook, Instagram, and YouTube. By joining and/or paying for a Silly Billy Sports program you hereby agree to such use by Silly Billy Sports. If you do not want your child’s photo published on the website or used in promotional material please email us at hello@Sillybillysports.com.au
CYBER SECURITY
The cyber security of all children is our paramount objective. The protection of your child’s safety is our most important role, we endeavor to only use trusted secure online and digital platforms. It is your right to request your child’s image not be publicly displayed, if you wish for this not to occur, please email hello@Sillybillysports.com.au
CONTROL OF SHARING
Members are not permitted to share links or videos of Silly Billy Sports class videos in order to protect our intellectual property.
FOOD AND DRINK POLICY
It is prohibited for food to be fed during any Silly Billy Sports class. Any child found to be fed food during a class will be asked to leave the venue immediately. Our classes structure include drink breaks so children must bring a water-filled drink bottle with them to each class.
COPYRIGHT
All materials contained on this site are protected by copyright law and may not be reproduced, distributed, transmitted, displayed, published or broadcast without the prior written permission of Silly Billy Sports or in the case of third-party materials, the owner of that content. You may not alter or remove any trademark, copyright, or other notice from copies of the content.
However, you may download material from this site for your personal, non-commercial use only.
FEE PAYMENT CURRENCY
All fees listed are in Australian dollars.
MEMBER CONDUCT
Inappropriate behaviour, physical, verbal or otherwise towards any employee, contractor, member or guest, may result in cancellation of your membership and removal from the premises. Management reserves the right to refuse entry to any persons and membership at its absolute discretion.
GOVERNING LAW
The site is administered by us from offices in Australia. These conditions and your use of the site and any disputes between you and us shall be governed by and construed in accordance with the laws of the State of Australia, without giving effect to any principles of conflicts of law. Any legal proceedings arising out of or in connection with the use of the site or supplies must be commenced in the appropriate court in the State of Australia. You are solely responsible for ensuring that your use of the site is not prohibited and complies with your local laws.
TERMINATION OF CONTRACT
Silly Billy Sports may at any time, terminate the Terms with you if:
(a) you have breached any provision of the Terms or intend to breach any provision;
(b) Silly Billy Sports is required to do so by law; or
(c) the provision of the Services to you by Silly Billy Sports, is in the opinion of Silly Billy Sports, no longer commercially viable.
SEVERANCE
If any provision of these conditions is unlawful, void or for any reason unenforceable, then that provision shall be deemed severed from these conditions and shall not affect the validity and enforceability of any remaining provisions.
